End User License Agreement & Terms of Service

Effective Date: February 24th, 2026

1. Agreement to Terms

This End User License Agreement and Terms of Service (“Agreement”) is a legally binding agreement between you (“User,” “you,” or “your”) and MTRC Golf, LLC (“MTRC,” “Company,” “we,” “us,” or “our”) governing your access to and use of the MTRC Golf mobile application and related services (collectively, the “Service”).

By downloading, installing, accessing, or using the Service, you agree to be bound by this Agreement. If you do not agree, do not use the Service.

This Agreement is between you and MTRC Golf, LLC, not Apple Inc. Apple is not responsible for the Service or its content.

2. Description of Service

MTRC Golf is a golf performance analytics application that:

• Allows users to input and track golf round shot data

• Analyzes performance statistics and scoring patterns

• Identifies performance gaps in a user’s game

• Provides suggested drills and practice recommendations

• Tracks progress over time

The Service does not provide live coaching and does not utilize artificial intelligence at this time.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. License Grant

Subject to this Agreement, MTRC grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

You may not:

• Reverse engineer or attempt to extract source code

• Copy, modify, or create derivative works

• Use the Service for commercial instruction or coaching without written permission

• Scrape, mine, or extract data

• Circumvent security features

All rights not expressly granted are reserved by MTRC Golf, LLC.

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information

• Maintain account security

• Accept responsibility for all activity under your account

You must be at least 13 years old to use the Service.

We reserve the right to suspend or terminate accounts at our discretion.

5. User Data & Content

You retain ownership of your submitted shot data and round statistics.

By submitting data, you grant MTRC Golf, LLC a worldwide, non-exclusive, royalty-free license to use, process, and analyze such data solely for:

• Operating and maintaining the Service

• Improving product features

• Aggregated and anonymized statistical analysis

We may use anonymized, aggregated data for research and product improvement.

6. Sports & Training Disclaimer

MTRC Golf provides statistical analysis and general practice recommendations based on user-submitted data.

The Service:

• Is not professional golf instruction

• Is not a substitute for a certified golf coach

• Does not guarantee scoring improvement

• Does not guarantee performance outcomes

Golf and golf training involve physical activity that carries risk of injury.

By using the Service, you acknowledge and agree:

• You voluntarily participate in golf and related practice activities

• You assume all risks associated with training and physical activity

• You are solely responsible for evaluating your physical condition before attempting drills

If you experience pain, injury, or medical concerns, consult a qualified professional before continuing.

7. No Performance Guarantees

We make no representations or warranties that:

• You will lower your handicap

• Your performance will improve

• The drills suggested will be effective

• The analysis is error-free

All recommendations are provided for informational purposes only.

8. Subscriptions & Payments

Certain features of the Service may require a paid subscription.

If you subscribe:

• Payments are processed through Apple In-App Purchases

• Subscriptions automatically renew unless canceled

• Cancellation must be completed through your Apple account settings

• Refunds are governed by Apple’s refund policies

We reserve the right to modify subscription pricing with notice as required by applicable law.

9. Intellectual Property

The Service, including its analytics systems, drill methodologies, design, software, and all related content, is the exclusive property of MTRC Golf, LLC and protected by intellectual property laws.

You may not:

• Copy proprietary methodologies

• Reproduce drill logic

• Create derivative products

• Use the Service to develop competing applications

10. Privacy

Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, and protect your information.

11. Third-Party Services

The Service may contain links to or integrations with third-party services. MTRC Golf, LLC is not responsible for third-party content, policies, or practices.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING:

• MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• NON-INFRINGEMENT

• ACCURACY OR RELIABILITY

We do not warrant that the Service will be uninterrupted, secure, or error-free.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MTRC GOLF, LLC SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES

• LOSS OF PROFITS, DATA, OR GOODWILL

• PERSONAL INJURY ARISING FROM TRAINING ACTIVITIES

• DAMAGES EXCEEDING THE AMOUNT YOU PAID TO US IN THE PRECEDING 12 MONTHS

Some jurisdictions do not allow certain limitations; therefore, some limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless MTRC Golf, LLC and its officers, directors, employees, and affiliates from claims arising out of:

• Your use of the Service

• Your violation of this Agreement

• Injury resulting from your participation in training activities

• Your violation of any third-party rights

15. Termination

We may suspend or terminate your access to the Service at any time for violation of this Agreement or for any lawful reason.

Upon termination, your license to use the Service immediately ends.

16. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles.

17. Dispute Resolution & Arbitration

Before filing a claim, you agree to attempt informal resolution by contacting us.

If unresolved, disputes shall be resolved through binding arbitration administered by the American Arbitration Association.

You agree:

• To waive the right to a jury trial

• Not to participate in class actions or class arbitration

Arbitration shall take place in Ohio.

18. Changes to Terms

We may modify this Agreement at any time. We will update the Effective Date accordingly. Continued use constitutes acceptance.

19. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and MTRC Golf, LLC regarding the Service.
